Faced with the slowness of criminal proceedings and the sense of impunity they can foster, the City of Carrières-sur-Seine has decided to establish a reference scale for daily administrative fines in cases of urban planning infractions. This measure aims to accelerate the resolution of situations where construction work is carried out without authorization, in non-compliance with a permit, or contrary to the Local Urban Plan (PLU).
Thanks to recent legislative changes, the Mayor now has administrative police powers allowing direct intervention. After an infraction is recorded via a report, the offender will be formally notified to regularize the situation within a defined period, under penalty of a daily financial fine. The offender will have the opportunity to present their observations before any decision is made.
The scale approved by the Municipal Council is progressive and intended to be dissuasive. It distinguishes several levels of infractions:
- Minor infractions (fences, facade renovation, roof windows): 15 days to 3 months, fine of €50 to €100 per day.
- Significant infractions (extensions, additions): 15 days to 4 months, fine of €100 to €300 per day.
- Major infractions (change of use, housing division, construction in protected zones): 15 days to 5 months, fine of €200 to €600 per day.
- Very major infractions: 15 days to 2 months, fine of €500 to €1,000 per day.
In addition to the daily fine, the Mayor may impose a penalty of up to €30,000. The objective is to set fine amounts transparently and equitably, while examining each situation on a case-by-case basis. The Municipality emphasizes the importance of vigilance for property owners and tenants planning renovations and encourages consulting the PLU available on the City's website or contacting the urban planning department (urbanisme@carrieres-sur-seine.fr) if in doubt.
